On-line
And Correspondence Lessons General Terms, Refunds And Cancellations:
Subscription
fees are non-refundable. Once payment is accepted, the student
gains access to the Bach To Basics Music website its lessons
and services for the specified time period. Due to the
electronic and educational nature of the products and services
offered there are no refunds for on-line lesson subscriptions or
services. The materials found at the site are transmitted on an
"AS IS" basis. Students are obligated to pay the
monthly subscription fee for accessing the site in full prior to
using the sites services with the exception of the free trial
period. When canceling a subscription it must be canceled at
least one day before the anniversary date of the original
subscription otherwise students will continue to be provided access
to the Bach To Basics Music site its lessons and services for
the remainder of the subscription period.
Due
to the educational nature of on-line lessons they are
non-refundable. Students will have six weeks from the date in which
they purchase a marking code to complete and submit their lesson
assignments for marking. Students are responsible for paying
postage for assignments sent to Bach To Basics Inc. for
marking. Bach To Basics will cover the postage for
returning the marked assignments to the student.
Bach
To Basics reserves the right to suspend privileges to any
student not adhering to the policies set forth by Bach To Basics Inc.
its site or services.
Bach
To Basics Inc. makes no representations about the suitability,
reliability, timeliness, and accuracy of the information, advice, or
services provided.
ELIGIBILITY
You
warrant that you are at least 18 years of age and possess the legal
authority to enter into this agreement and to use the services
offered on this site in accordance with all terms and conditions
herein. The services offered by Bach To Basics Inc. are
available only to individuals who can enter into legally binding
contracts under the law of the province of Alberta Canada.
Without limiting the foregoing, the services are not available to
minors. The Student hereby agrees to supervise usage by, and be
responsible for the actions of, any minors who use the account to
access the Bach To Basics Music web site or services.
PROHIBITED
USE
The
Bach To Basics Music web site and services contained herein
are used for the purpose of receiving or delivering music
instruction, teaching, and advice. You may print materials from
the Bach To Basics Music web site for personal or educational
purposes only, and you must include any copyright notice originally
included with the materials in all copies. You may not modify or use
the materials for any other purpose without Bach To Basics Inc.'s
express consent
Students
are entirely responsible for maintaining the confidentiality of
their user id, password, and account provided by Bach To Basics Inc.
for accessing the site. Transferring of a student id and
password is strictly prohibited.
Bach
To Basics Inc. will not be liable for any loss that you may
incur as a result of someone else using your id and password for
accessing your account, either with or without your knowledge.

Bach To Basics Inc. nor its website verify, endorse, or take
responsibility for the accuracy, currency, completeness or quality of
content contained at these sites.

NOTIFICATION

files, materials, and assignments provided by, or found on the Bach
To Basics Music web site are protected by copyright laws.
You may not, under any circumstance, reproduce, record, publish,
publicly exhibit, or distribute any correspondence, electronic, or
media files made available from Bach To Basics Inc. its web
sites or services without written consent. You may not link
directly to any files located in the subscribers area, and you should
not attempt to pass off any of the content purchased from Bach To Basics
or the Bach To Basics Music web site wether electronic or
otherwise as your own.
INDEMNIFICATION
You
agree to indemnify, defend and hold harmless, Bach To Basics Inc.,
its web sites affiliates, and their respective officers, directors,
employees, agents, licensors, representatives, and third party
providers to the site from and against all losses, expenses, damages
and costs, including reasonable attorney's fees, resulting from any
violation of this agreement by you.

Notwithstanding
the foregoing, in no event shall Bach To Basics Inc.'s
agreeable liability to you for any and all claims, damages, losses,
and causes of action (wether in contract, tort or otherwise) exceed
the amount paid by you to Bach To Basics Inc., if any, in the
(12) month period prior to any dispute
CORRESPONDENCE
COURSES & LESSONS
There
are no refunds for correspondence lessons. Students will have
six weeks from the time they purchase a correspondence lesson to send
assignments in for marking. Some correspondence lessons may
include a compact disk, in the rare event that the compact disk is
found defective, a replacement disk will be sent free of charge to
the student upon Bach To Basics
receipt of the damaged disk. Students are responsible for
paying the postage of assignments sent to Bach To Basics Inc.
for marking. Bach To Basics will cover the postage for
returning the marked assignments to the student.
MISCELLANEOUS
This
agreement will become effective immediately upon any use of the site
and shall remain effective unless terminated by either party as
provided hereunder.
Either
party may terminate this agreement by providing the other with
written or e-mail notice of such termination, which shall be
effective immediately upon delivery of such notice to the other
party. Bach To Basics Inc. may terminate this agreement
immediately without notice for any breach by the student in this
agreement or any applicable policy of Bach To Basics as posted
on the site from time to time. |
